A purchase does not improve your chance of winning. Void where prohibited, taxed or otherwise restricted by law. Subject to all federal, state and local laws. Contestants may enter only once during a 24 hour period (regardless of name or contact information provided). Entrants must post a comment in the comment section of that day's sweepstakes post. Only posts that have been approved and published by the editors of www.thebudgetfashionista.com will be eligible for entry into the sweepstakes. TBF Group, LLC (“TBF”) reserves the right to disqualify entries that contain “inappropriate” content as determined by the sole discretion of TBF. TBF also reserves the right to not award prizes to contestants who do not comply with these rules, or for other reasons which violate the rules or spirit of the sweepstakes. .
WHO CAN PARTICIPATE?.

This sweepstakes is open to all legal residents of the United States and District of Columbia, U.S. Military personnel (and their families) with APO/FPO addresses, Alaska and Hawaii, who are eighteen (18) years of age or older (void in Puerto Rico). Participation in this sweepstakes constitutes entrant's full and unconditional acceptance of these Official Rules..
HOW DO I ENTER?.

The sweepstakes begins at 12 am EST on September 27, 2009 and ends at 11:59 pm EST on October 26, 2009 (the “Sweepstakes Period”). Enter on-line at www.thebudgetfashionista.com, by posting a comment in the comment section of that day's sweepstakes post, by posting a comment on the Budget Fashionista's/Kathryn Finney's Facebook page, and/or by posting a retweet containing the words "@KathrynFinney" AND "#Maxxinista" on Twitter. All sweepstakes posts open at 12:00am EST and close at 11:59pm EST the same day. All entries received outside of the designated sweepstakes Period will be disqualified. Receipt of entries will not be acknowledged.
Winners will be chosen and notified via email within 72 hours of the end of the day on which the entry was made (the “Notice”). Winners will have 48 hours from the time posted on TBF’s sending of the Notice to respond to an email request for contact information. If no information is received, the winner forfeits prize and another winner may, but is not required to be, chosen..
All Internet access and usage charges are the responsibility of the entrant. If for any reason the Internet portion of the sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, fairness, integrity or proper conduct of the sweepstakes, TBF reserves the right at its sole discretion, to terminate, modify or suspend the sweepstakes. TBF assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. TBF is not responsible for any problems or technical malfunctions of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of any e-mail or entry to be received by TBF on account of technical problems or traffic congestion on the Internet or at any web-site, or any combination thereof, including any injury or damage to entrant's or any other person's computer related to or resulting from participation or downloading any materials in this sweepstakes. In the event of a dispute, eligible electronic entries will be considered made by the authorized account owner of the email address submitted at the time of entry. Entries generated by robots or scripts are considered to be a direct violation of sweepstakes policy and will result in immediate disqualification of any and all associated entries. TBF is not responsible for printing errors in these Official Rules.

Daily prize (awarded for each day of the sweepstakes, for a maximum of 20 days) for comments posted on Kathryn Finney Facebook Fan Page is a TJ Maxx gift card worth a $25.00 value.
Daily prize (awarded for each day of the sweepstakes, for a maximum of 20 days) for comments posted on Twitter is a TJ Maxx gift card worth a $25.00 value.
Daily prize (awarded for each day of the sweepstakes, for a maximum of 20 days) for comments posted on www.thebudgetfashionista.com is a TJ Maxx gift card worth a $25.00 value.
In addition to the daily prizes, there will be one weekly prize (awarded each week of the sweepstakes, for a maximum of 4 weeks) of a TJ Maxx gift card worth a $500.00 value.
All warranties for prizes are hereby disclaimed, and the winner will accept the prize “as is”. Prizes cannot be assigned, transferred, exchanged or redeemed for cash. All fees and personal expenses incurred by a winner to redeem his/her prize are the sole responsibility of the winner. A winner may be required to repay any prize that has been received as a result of fraudulent or unauthorized activity.
HOW IS A WINNER SELECTED?
During the sweepstakes Period, eligible entries received online at www.thebudgetfashionista.com will be combined with entries from Kathryn Finney-The Budget Fashionista Facebook pages and Twitter retweets to create the entry pool from which each daily prize winner will be selected. Each winner will be selected in a random drawing from all eligible entries received by TBF, whose decisions regarding all aspects of the sweepstakes shall be final and binding.
The entrant must be the sole creator of the post, and must not knowingly submit any information which is false or which a third party has a right, title or interest. The odds of winning one of the prizes will be determined by the number of entries each day. Prizes will be mailed within sixty (60) days after the close of the sweepstakes Period. If a winner declines to accept a prize, or in the event that a prize or prize Notice is returned as undelivered, the winner will be disqualified and TBF may elect, at its sole discretion, to select an alternate winner. By participating, entrants release TBF, its affiliated businesses, advertisers, promoters, advertising and promotion agencies and the officers, directors, employees and agents of each from any and all liability, damages or causes of action (however named or described) whatsoever, including, but not limited to claims for injuries, damages or losses to persons and property which may be sustained in connection with receipt, enjoyment, ownership or use of the prize. Winner grants permission to TBF to use winner's name, age, city, state, photograph or likeness for advertising and promotional purposes without additional compensation or approval.
DISPUTES

Each entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of New York; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this sweepstakes, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and TBF in connection with the sweepstakes, shall be governed by, and construed in accordance with the laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of New York or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of New York.
